By using or accessing the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. In these Terms of Use, the expressions we, us and our are a reference to Didgigo.

These Terms of and Conditions of Use (“Terms of Use”) apply to the Website, including the purchase of goods and services over the Website.  These Terms of Use must be read in conjunction with all other applicable terms and conditions governing the use of the Website.
These Terms apply to all visitors, users and others who access or use the Service. You warrant that you are at least 18-years-old and you are legally capable of entering into binding contracts. As Didgigo is an online service; our primary means of communication with you will be via the email address listed on your order. Didgigo will not be held responsible for any missed communication due to the email address being incorrect. The Service and its original content, features and functionality are and will remain the exclusive property of Didgigo IP PTY PTD, its licensors or its content suppliers. The Service is protected by copyright, trademark, and other laws of both the Australia and foreign countries. Nothing in these Terms constitutes a transfer of any Intellectual Property rights from us to you.

Tripigo – Apple/Google Play App
Tripigo is an easy to use device app which allows you to:
– View your whole journey at a glance
– Access itinerary events, times and details
– Use your device map provider to navigate to your accommodation, tour, destination or point of interest
– Receive suggested attractions, points of interest, dining and shopping.

Termination
We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection therewith.
If applicable law requires us to provide notice of termination or cancellation, we may give prior or subsequent notice by posting it on the Service or by sending a communication to any address (email or otherwise) that we have for you in our records.

Governing Law
These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
It is your sole responsibility to periodically check these Terms for any changes. If you do not agree with any of the changes to these Terms, it is your sole responsibility to stop using the Service. Your continued use of the Service will be deemed as your acceptance thereof.

Terms and Conditions of Purchase

Prices

All prices are listed in US Dollars unless otherwise indicated.

All prices listed on the website are inclusive of applicable delivery and order charges. Where goods and services tax is required to be included, prices are inclusive of goods and services tax.

For any orders shipped outside of Australia the customer is the importer of record and will be responsible for all customs import duties and sales tax charges. These charges vary in each country and are outside of Didgigo’s control. Contact your local customs office for more information on what import duties or sales taxes may be imposed.

Ordering Goods

You may make purchases via the Website by selecting and placing your order in accordance with these Terms and Conditions and as directed on the Website. Any order placed by you in the manner described in the Website is an offer by you to purchase a particular product or service for the price (including the delivery and other charges) specified on the Website at the time you place your order.

You confirm that you are ordering the correct title, format, and quantity of the items in your shopping cart and request Didgigo to provide these items on your behalf. You verify that these items are being purchased for personal or business use and are not being purchased for commercial resale.

You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods or services ordered unless you ask us to cancel that order, and we send you written confirmation of the cancellation prior to the goods or services being dispatched to you.

Payment of Goods

We accept payment with the following credit cards:

MasterCard, Visa, American Express

Credit cards payments may be processed in real-time by our encrypted SSL secure server and payment gateway (“Stripe“).  Your credit card is charged once you have selected to proceed with your order. A confirmation page will confirm you have successfully placed the order.

You warrant that all details you provide to us when placing an order are current, correct and complete, that you are an authorised user of the credit or debit card used to place your order and that your nominated credit or debit card will cover the full cost of the purchase. Purchases will not be dispatched until payment is completed and received by Didgigo. If we are unable to successfully process your credit or debit card payment for your order, we may notify you of dishonour and cancel your order.

Didgigo may change the prices published on the Website at any time. You agree to pay the price current at the time of payment.

Delivery of Goods

Didgigo will arrange post or a courier on your behalf, for the goods ordered by you to the person and address you give Didgigo at the time you make your order. All delivery times quoted on the website are estimates only, based on availability, normal processing and delivery companies.

Didgigo relies upon the delivery details provided by you (“the User“) and cannot be held accountable for errors in the information provided.
The Provider uses third-party vendors to perform delivery services and as such cannot be held responsible for delays due to circumstances beyond the Providers control.

International Orders

Deliveries to destinations outside Australia are made by third-party vendors / couriers, and cannot be made to post office boxes.

Please note that some countries may charge the recipient duties on the ‘import’ of parcels from time-to-time. As these charges are the responsibility of the recipient, please check the customs service in your destination country to see if charges are applicable.

Insufficient and/or Incorrect Delivery Information

Customers who enter addresses that are deemed as having incorrect and/or insufficient details to ensure delivery may result in the following:

Delayed delivery, Lost parcel, Package/s returned to the third-party vendors

Please note that if the delivery address is insufficient or incorrect and the order has been shipped, we may not be able to change the delivery address until the order has been returned. If your order has not yet been shipped you will need to send Didgigo an email advising the error and requesting a change in details.

Unfortunately, you will be liable for any costs incurred in return to sender parcels if the information you provided was insufficient or incorrect.

Any shipment that is delayed or lost and is found to have had incorrect and/or insufficient details provided by the customer will not be covered by Didgigo. NO REFUNDS and NO STORE CREDITS are applicable.

If Didgigo is found to be responsible for incorrectly addressing a package then Didgigo will be responsible for the resending, replacement or refund of the items not delivered or delayed.

Digital Orders

When purchasing a Digital Roadbook the Customer acquires access to the Digital Content. Once a Customer accesses or downloads any Digital Content that they purchase, they no longer have the right to cancel their purchase of that Digital Content.

Didgigo’s obligations to the Customer with regards to the supply of the Digital Content is fulfilled when the Digital Content is downloaded. It is your responsibility not to lose, destroy, or damage Digital Content once downloaded.

Terms of Use of Digital Content: Digital Content may not be copied, shared or otherwise distributed.
Content is available for personal use only
Applicable use is within relevant Laws.

Didgigo reserves the right to enforce applicable Terms of Use relating to the Digital Content.
